How our search works
From order to delivery in 2 business days. Here is exactly what happens at each stage.
Step 1: Place Your Order
Select your search tier and provide the mark you want to search, the goods or services you plan to offer, and the Nice Classification class if you know it (we identify the class if you do not).
Step 2: Database Sweep
We search three layers using phonetic, visual, and semantic matching algorithms.
Federal: The entire USPTO database of live, pending, and dead trademark registrations and applications.
State: All 50 state trademark registers. A mark registered only at the state level does not appear in the USPTO database but can block your federal registration.
Common law: Business entity filings, assumed name registrations, domain name records, and web presence data. In the United States, trademark rights are established by use in commerce — not by registration.
Step 3: Attorney Review
A licensed U.S. trademark attorney reviews every result, evaluates each potential conflict using the DuPont factors, and assigns a risk level: high, moderate, or low. At the Search + Opinion tier, the attorney writes a formal opinion letter. At the full-service tier, the attorney also prepares for a 60-minute consultation call.
Step 4: Report Delivered
Your complete report is delivered within 2 business days in PDF format. If you selected the full-service tier, your consultation call is scheduled within 5 business days of delivery.
After Your Search
If the results are clear and you decide to proceed with registration, the full $999 Search + Opinion + Consult fee is credited toward a registration package if you engage within 7 calendar days. If conflicts are identified, the opinion letter explains your options: modify the mark, narrow the goods description, seek consent, or choose a different mark.
